Protecting Your Interests Before Divorce

In Pennsylvania, you are either married or you are not. However, as your family lawyer, I can help you create an agreement to get you through the time in between marriage and finalizing your divorce.

Your separation agreement may outline many issues that will be officially be determined during your divorce, such as:

Separation does not free you from your obligations to support your child. If your situation calls for a formal child support agreement, that can be included in a separation contract as well.

Annulment: An Alternative Option

Some situations call for ending a marriage outside of the divorce system. Divorce ends a marriage. Annulment, on the other hand, voids it completely. There are a few circumstances in which Pennsylvania courts will grant an annulment, including:

  • When one of the parties is already married before the marriage (polygamy)
  • If one party does not want to procreate and the other party thought they would have children
  • If one party has a sexually transmitted disease (STD) and did not disclose that information to the other party
  • If one party was forced into the marriage
