Family Law
Issues related to family and domestic relations come under or are dealt by a specific area of law known as the Family Law. The domestic relations under this law are categorized into various forms like the divorce, equitable distribution of property, alimony, child support, visitation etc. As the diversification in the domestic relations are huge and govern enormous categories in it, a number of legal authorities are established with courts of limited jurisdictions, also called as the Family Courts which take up or deal with domestic cases exclusively. The family law includes various potential issues while dealing with the cases, which include:
- The issues related to the different faces of marriages: – A marriage is defined as an interpersonal relationship which could be performed in a variety of ways, inheriting the rules and regulations of the culture in which it has taken birth. As cultures vary, the marriage Proceedings also vary accordingly. In order to confluence the two issues wedding ceremonies are held between individuals of same cultures and social classes. The role of the religious authorities usually is to govern the validation of marriages, which is therefore named or viewed as a contract, in accordance to the marriage laws of the jurisdiction.
- The Family Law usually deals with issues which come over at the time of marriages, which lead to a wide variety of disputes which include issues related to domestic violence like the spousal abuse (dealing with the abusive behavior of one or both of the partners). The domestic violence also shelters cases related to physical harassment like harming the spouse in various ways like hitting them, biting, throwing things at them and many others which would harm them. Many other issues which cause harmful effects to the spouse and illegal or unlawful acts performed on them are taken under the disputes solved by the domestic law, which are over all governed and taken to the notice of the judiciaries by filing up the cases under the Family Law.
- The Family Law on the other hand also deals or takes up issues related to breaking up of relations like the divorce, cases due to low levels of symbiosis between the two partners who were legally married to each other. The issue of property sharing arises in such cases where the property is to be equally distributed between the spouses at the time of divorce, which is a legal action, performed by the judicial, called as the property settlement.
